Biography

Chloe is a senior associate solicitor in the regulatory department at Stephensons specialising in education, health and social care regulation, and professional discipline.

Ofsted and CQC regulation

Chloe assists and represents registered providers and managers facing enforcement action by the Care Quality Commission (CQC) and Office for Standards in Education, Children’s Services and Skills (Ofsted) and Care Inspectorate Wales (CIW). In particular, Chloe provides advice on compliance, challenging inspections, criminal investigations, prosecutions, enforcement action, and appeals to the first-tier tribunal (Care Standards Chamber). Chloe assists providers and managers in relation to the following:

• Challenging inspection reports and ratings/gradings;
• Drafting complaints and internal reviews;
• Drafting representations in in response to notices of intention/proposal to refuse, cancel, or impose/vary conditions of registration
• Appealing suspension notices, notices to impose or vary conditions on registration, notices to restrict accommodation, and cancellation notices to the first-tier tribunal; and
• Advice in relation to criminal investigations and representation at interviews under caution
• Advice in relation to unregulated and unregistered provisions

Chloe has acted as a judge at the British Care Awards and the Children and Young Person’ Awards.

Professional discipline

Chloe represents and advises a wide range of professionals across a number of sectors before their professional regulators. Chloe assists professionals facing fitness to practise proceedings, from the initial referral and investigation stages, through to final fitness to practise panel hearings and sanction review hearings. Chloe also assists with interim orders, registration proceedings, and registration appeals.

Houses of multiple occupancy & licensing

Chloe advises and assists landlords, managers, and letting agents in relation to houses of multiple occupancy (HMO) issues. In particular, Chloe provides advice and representation in relation to:

• Licensing applications (including refusals and revocations);
• Enforcement action, including representation at interviews under caution, challenging civil penalties, prosecutions, and appeals to the first-tier tribunal; and
• Rent repayment orders.

Chloe has experience in dealing with a number of different local authorities across England. Chloe assists landlords from the very early stages of an investigation to prosecution, including representation at interviews under caution (known as PACE interviews). Chloe also assists landlords with criminal prosecutions before the Magistrates Court, she drafts representations to challenge financial penalties imposed, assists with appeals before the first-tier tribunal, and assists with rent repayment orders before the first-tier tribunal.
