What is a work-related silicosis compensation claim?

A work-related silicosis compensation claim is where an individual seeks financial compensation for silicosis caused by exposure to harmful silica dust in the workplace.

What is silicosis?

Silicosis is a life changing and potentially fatal lung condition which is caused by exposure to large amounts of crystalline silica dust, a substance which is naturally found in certain types of stone, rock, sand and clay. Working with these materials can create a very fine dust which can be easily inhaled. Once inhaled, it can cause swelling and subsequent scarring to the lungs which affects their functioning. The symptoms can appear many years after you worked with silica dust and usually begin with symptoms of coughing, shortness of breath and tiredness/weakness.

Who is at risk of exposure to silica dust?

People who work in the stone masonry and stone cutting industry (especially with sandstone), people who work in construction and demolition, people who manufacture and fit worktops, people who work in pottery, ceramic and glass manufacturing, people who work in sand blasting and people who work in mining/quarrying are particularly at risk of exposure to silica dust.

There has been a particular increase in recent years of exposure to silica dust by workers who cut artificial or engineered stone for the purpose of making cheaper kitchen worktops than those made from granite or marble. It has been found that these artificial stone worktops contain high concentrations of silica, which could be breathed in by the stonemasons cutting this material, some of whom are only in their 20s and 30s.

How do I claim for silicosis compensation?

To claim for silicosis compensation, your solicitor will help to gather all medical records and evidence related to the disease, before submitting the claim to your former employer or their insurers. We will guide you through the legal process and help you make a claim for compensation. We will seek interim payments where possible to help you financially whilst awaiting the outcome of the claim.

How do I prove my silicosis claim?

To prove your silicosis claim, we will help you to gather all relevant medical records, reports, and test results documenting your diagnosis and treatment. We will request any supporting evidence such as X-rays, CT scans, or lung function tests. We will also obtain your employment history from HMRC to investigate where you may have been exposed to silica dust and will take witness statements from former colleagues, where necessary.

How long do I have to make a claim for silicosis?

The time frame for making a claim for silicosis can vary depending on the circumstances, but is usually three years from the point of diagnosis (or from the date you realised your silicosis was caused by your work), as usually silicosis develops many years after the exposure. If you are claiming on behalf of a family member who has sadly passed away due to silicosis, you have three  years from the date of death to pursue a claim on behalf of their estate, as long as their diagnosis was not more than three years before their death. It is advisable to consult with a legal professional specialising in personal injury or industrial disease cases to determine the specific time limits in your situation, but you should do this as soon as possible to avoid missing any time limits.

How long does a silicosis compensation claim take?

The duration of a silicosis compensation claim can vary widely depending on the specific circumstances of the case, complexity of the claim, and the legal process. It can take several months to several years to reach a resolution depending on whether your former employer accepts responsibility for your condition and whether they dispute the value of your claim. We will support you through the entire process, no matter how long it takes.

What is the prognosis for silicosis?

There is currently no cure for silicosis and it can lead to a deterioration in health to the extent where it is not possible to continue working and where long-term care is required. This is why it’s so important to seek advice, in order to cover any loss of earnings and care costs.

How much compensation for silicosis?

The amount of compensation for lung damage can vary greatly depending on the severity of the injury, medical expenses incurred, lost wages, and other factors. It is best to consult with a lawyer who specialises in personal injury cases to determine a more accurate estimate for your specific situation.

Can I pursue my silicosis claim on a “no win no fee” basis?

Yes, most of our injury cases are dealt with on a “no win no fee” basis. A no win no fee personal injury claim is a legal agreement where the claimant is not required to pay any legal fees if their case is unsuccessful. In the event of a successful claim, the majority of the lawyer's fees are typically recovered from the other party.
