Am I entitled to any benefits?

You may be able to receive financial assistance from the Department for Work and Pensions (DWP) if you have been diagnosed with an industrial disease. The DWP awards a benefit known as Industrial Injuries Disablement Benefit (IIDB) to sufferers of the following asbestos-related medical conditions; 

  • asbestosis (a form of pneumoconiosis)
  • diffuse mesothelioma
  • primary carcinoma of the lung
  • mesothelioma
  • pleural thickening.

Eligible sufferers receive a regular payment, calculated on a sliding percentage scale, according to the level of disablement assessed in their individual case.

If you are diagnosed with mesothelioma, you would not normally have to attend a medical assessment and you would receive the highest weekly payment on the scale.

In addition to IIDB, there are various lump sum payments available and Stephensons can advise you in detail regarding your eligibility. Such payments are often made in the following circumstances;

  • you are unable to trace a previous employer
  • no insurance can be traced for your previous employer
  • your exposure took place prior to June 1954
  • you were exposed due to washing your partner’s work clothes
  • you were exposed when living close to a factory where asbestos was used

Asbestos claims on behalf of a family member

It is very important to bear in mind that when a loved one passes away due to an industrial disease, a claim can still be made for them. 

Sadly, many sufferers only discover they have a serious asbestos-related condition when they are already in the advanced stages of the disease. We understand that there are far more important considerations to be had at this incredibly difficult time, however, sufferers can draw some comfort from the knowledge that a claim will help to provide financially for their relatives after their death.  

A claim on behalf of the late sufferer’s estate should be made as soon as possible and court proceedings must be issued within three years of the date of diagnosis.  

Industrial disease-related deaths are always reported to the local Coroner, who may ask that a formal inquest takes place. Stephensons have experience of supporting bereaved clients during this process and have attended inquests with them. The Coroner’s report can assist in building a case against the sufferer’s previous employers.

A bereaved spouse or civil partner can claim a bereavement award and may also be entitled to additional benefits. If the family member did not leave a will, compensation is distributed to their next of kin in accordance with the rules of intestacy.
