Cases of note

Katie secured an award of £70,000 for a cyclist client who was a victim of a road traffic accident involving an Untraced Driver. He suffered significant injuries as a result, which affected his capacity for work and day to day life. The claim was submitted against the Motor Insurers’ Bureau (MIB). Medical evidence was obtained from multiple experts including orthopaedic, spinal, and psychiatric. All potential heads of loss were carefully considered to ensure our client received the right level of compensation.

Katie secured an award of £75,000 on behalf of a road traffic accident victim. As a result of the accident the client sustained injury to his lower back which advanced on the onset of symptoms associated with constitutional degenerative changes by a period of four to five years. The settlement included a significant sum for potential future loss of earnings as the client would be disadvantaged on the open labour market as a result of his injuries.

Katie secured an award of £37,085 or a client who sadly passed away due to asbestos exposure. The claim was brought on behalf of his estate by a family member. Liability was denied and court proceedings were issued. Ultimately it was found that the clamant had suffered a number of asbestos related diseases such as diffuse pleural thickening associated with pulmonary fibrosis, and his life expectancy had been reduced by three years. Expert evidence was obtained and the claim was settled before trial.

Katie acted for a child who was seven years old at the time of the accident, and 14 at the date of trial. She injured her knee in a public park and suffered a laceration to her knee. She developed lethargy and fever over the coming days and was admitted to hospital with septic arthritis and referred for surgery. She underwent two procedures for knee wash-out and also developed pneumonia, therefore she was admitted to the intensive care unit for one day. Thankfully she made a good recovery but was left with multiple scars to her knee. She also suffered symptoms of anxiety. Liability was admitted at an early stage but the value of the claim was heavily in dispute. Medical evidence was obtained from multiple types of expert including orthopaedic, psychological and a plastic surgeon. A settlement could not be agreed before trial and a hearing went ahead in respect of the correct level of damages. The Judge found in favour of our client and awarded £25,174, taking into account the serious nature of this injury. Read full case study.
